US – There have been violent attacks in Turkey, and the possibility of terrorist attacks against U.S. citizens and interests, from both transnational and indigenous groups, remains high.

UK – The Foreign and Commonwealth Office (FCO) advise against all travel to within 10 km of the border with Syria.

The FCO advise against all but essential travel to:

the remaining areas of Sirnak, Mardin, Sanliurfa, Gaziantep, Kilis and Hatay provinces
Siirt, Tunceli and Hakkari provinces.

Tunisia:

  • the militarized zone south of, but not including, the towns of El Borma and Dhehiba
  • within 5km of the Libya border area from north of Dhehiba up to but not including the Ras Ajdir border crossing

The FCO advise against all but essential travel to the rest of Tunisia.

US:

The U.S. Embassy recommends that U.S. citizens in Tunisia maintain a high level of vigilance, as terrorism remains a significant concern.

U.S. citizens should exercise caution when frequenting public venues that are visited by large numbers of foreigners, such as hotels, shopping centers, tourist sites and restaurants. Two recent attacks targeted foreign tourists: March 18, 2015, at the Bardo Museum in Tunis; and June 26, 2015 near Sousse at the Riu Imperial Marhaba and Riu Bellevue Park hotels.  The Islamic State of Iraq and the Levant (ISIL) claimed responsibility for both attacks.  U.S. citizens should also be alert to the possibility of kidnapping.

Terrorist organizations have also targeted Tunisian security forces and government installations.  The Tunisian government officially designated the group Ansar As-Sharia in Tunisia (AAS-T), a group with known anti-U.S. and anti-Western sentiments, as a terrorist organization on August 27, 2013.  The Tunisian government continues security force operations against AAS-T, ISIL and al Qaida in the Islamic Maghreb (AQIM).  The Tunisian President declared a state of emergency throughout the country on July 4, 2015, giving the Tunisian government greater powers to control public order.

Maryland Mother Fighting To Get Kidnapped Son Back From Tunisia

A Maryland mother fighting for years to get her kidnapped son back to the United States. Eslam Chebbi, 8, was abducted by his father and taken to Tunisia in 2011.

Meghan McCorkell spoke with his mother about new hopes he can return home.

It’s been nearly a year since Edeanna Johnson-Chebbi was able to see her son inside a Tunisian courtroom after he was abducted by his own father.

In October of 2011, Edeanna Johnson-Chebbi’s two children were on a scheduled weekend visit with her ex-husband when she got a devastating phone call.

“It was the worst phone call of my life–that he had the children, they were in Tunisia and I’d never see them again,” said Johnson-Chebbi.

Her ex-husband is now on the FBI’s Most Wanted list for parental abductions.

Johnson-Chebbi has won custody of her kids in both the U.S. and Tunisia. She managed to bring her daughter, Zainab, home last year. But her son, Eslam, remains with his father.

Now she believes President Barack Obama might be able to help.

On Thursday, the president met for the first time with the newly elected leader of Tunisia in the Oval Office.

“I indicated to the president my intention to designate Tunisia as a major non NATO ally of the United States,” President Obama said.

Johnson-Chebbi hopes her son’s case may have been part of the discussion.

“I would hope that he would express his concern as a father for the rights of a son to be home with the family that he was torn away from,” she said.

Maryland lawmakers have also been pushing to reunite the family.

“Child abduction cases are heartbreaking. They’re heartbreaking,” said Senator Ben Cardin, (D) Maryland.

Now, with Eslam’s ninth birthday just days away, Johnson-Chebbi has a message for him:

“His sister and I and his grandparents and all of his family pray for him and we think about him and we talk about him and his spirit is alive in ours every moment of every day,” said Johnson-Chebbi.

And she hopes he will spend his next birthday here at home.

Both senators Cardin and Mikulski have written letters to the Tunisian president, asking him to intervene in the case.

Inte sällan intar myndigheterna en position av bevakande art, där de hänvisar till polis, åklagarmyndighet och internationella överenskommelser som Haag konventionen. Om det land dit barnet blivit bortfört har skrivit under internationella överenskommelser finns åtminstone en möjlighet att få tillbaka sitt barn, men räkna med att det kommer kosta.

Stora summor går till advokatkostnader, resor och tid. Det är inte ovanligt att det förflyter både två och tre år innan det blir ett resultat, som efter så lång tid kan gå åt endera hållet. Finns inget överenskommet avtal med landet är sannolikheten obefintlig att få hem barnet med myndigheternas hjälp.

I dessa fall så finns det privata aktörer som specialiserat sig på att gå in och aktivt hjälpa till för att hitta en lösning. Det kan vara att gå in och förmedla, utöva påtryckningar eller helt enkelt lokalisera barnet och bistå den kvarlämnade föräldern aktivt i ett tillbakatagande. Det man alltid skall försöka uppnå är att ha den rättmätiga föräldern fysiskt på plats vid en sådan aktion. I alla fall när det måste gå till den nivån är för arbetet extremt viktigt.

Innocents Abroad: The Rise of Cross-Border Child Abduction by Parents

In recent years, the world has seemed a more connected place.

Palm-sized technology has condensed contact between continents while the flow of people across time zones has increased dramatically.

Experience of new horizons – and the different cultures, cuisines and tongues which comes from it – has made for a more cosmopolitan life.

However, official research and the daily caseload of myself and other family lawyers all too often illustrates that there can be negative consequences.

The number of international family disputes requiring the involvement of UK courts has almost quadrupled in the space of only four years, according to a report published by one of this country’s most senior judges.

The data, which was published by Lord Justice Thorpe, who acts as the Head of International Family Justice for England and Wales, showed there were only three new cases of that type handled by the office in 2007. The following year, the total had risen to 65 but by the end of last year, it had reached 253.

Lord Justice Thorpe said that the matters involved child abduction, adoption and forced marriage and were due, he claimed, to “globalisation, increasing movement of persons across borders, and the ever rising number of family units which are truly international”.

His remarks confirm something which is all too apparent to myself and my colleagues atPannone LLP, as we have remarked upon previously.

The comments are also supported by figures released not by the courts but by Government which evidenced what many believe to be at the heart of the trend which Lord Justice Thorpe is witnessing.

Last year, the Foreign Office published its own figures, illustrating that the number of parental child abductions which it had been called upon to assist in had climbed by 88 per cent in a decade.

It revealed that a specialist unit which it had set up to deal with the problem was getting four calls every day, half of which were turning into new cases.

Of course, it is not only relationships forged by individuals of different nationalities which run into difficulties. However, when these partnerships break down, there is often a natural tendency to return to family and familiar surroundings to recover from any feelings of disappointment or distress.

Where children are involved, such matters become more complicated, especially when one or other partner decides to remove them from the country in which they had been resident.

A country’s incidence of these sorts of cases mirror its ties with other states. The Foreign Office cited parental child abductions involving 84 different nations. According to Lord Justice Thorpe’s report, Poland, Pakistan and Spain were the three places which featured most frequently in the disputes which came to his attention.

Once removed, children are sometimes only returned after a complex process which can be long and drawn out. There can be serious ramifications for the families concerned, both legally and emotionally.

Taking a child out of the country without the express permission of a court or the other parent can be a criminal offence. No matter how comforting the prospect of returning to one’s family overseas might seem once a relationship has broken down the consequences need to be seriously considered.

Sadly, my workload and that of other family lawyers specialising in these cases shows no sign of letting up, regardless of the legal and personal consequences. If anything, the increasingly common nature of international partnerships makes further rises likely.

Given the prominence of Poland in figures from both Lord Justice Thorpe and the Foreign Office, it will be interesting to see whether allowing two other East European countries – Romania and Bulgaria – to live elsewhere across the continent without limitation will further fuel the number of international family units living in Britain and the terrible complications of their breaking apart.

In November 2012, on behalf of the company ABP World Group, Daniel Bakke, 37, and Per-Åke “Pelle” Helgesson, 54, went to Tunisia together with a Norwegian woman to  help her retrieve her child  who had been illegally taken by the child’s Tunisian father.

Instead, they were arrested by Tunisian police on suspicion of preparing an armed kidnapping. Since their arrest in November, the Norwegian mother has been awarded sole custody of the child in both Norwegian and Tunisian courts, but the Swedes remain in the Mornaguia prison, southwest of the capital Tunis without trial.

Due to the fact that the legal system in Tunisia will close for summer vacation, they now face the risk of spending at least another four more months in prison – and the Swedes are starting to lose hope.

“I cannot take another setback now. I’m exhausted and have to go home to my children”, Pelle writes in a letter from prison.

FACTS

This has happened:

November 11, 2012: The two Swedes went together with a Norwegian woman to Tunisia to help her retrieve her child that the child’s father had illegally taken from Norway.

November 17 2012: Daniel Bakke’s brother, Christian Franzetti, says in an interview to Aftonbladet that the Swedes are suffering in the Tunisian prison, only getting dry pieces of bread and bad water. According to their lawyer, they risk up to ten years in prison for attempted kidnapping.

January 11, 2013: Aftonbladet published a letter written by Per-Åke “Pelle” Helgesson and smuggled out from prison in which he says that there are bed lice and they have been denied visits, are being harassed and abused, both mentally and physically, by the police,”

June 20, 2013: The Swedes are denied the preliminary investigation which should have been carried out by a so-called pre-trial judge. They instead refer the case to criminal court.

Want to get attention

Now the men’s families come forward in the hope that the case will get attention and that the men will be freed.

Melody Guarino Bakke, in December celebrated one-year wedding anniversary but she was alone at the couple’s home in the Philippines, while Daniel was locked up in a Tunisian prison – There are no words to describe the situation. Daniel is the first thing I think of when I wake up and the last when I go to bed, she says to Aftonbladet.

Her wish is that the Swedish authorities and the State Department put more effort into helping free the two Swedes.

Last Thursday the relatives received more bad news when a judge rejected a request that the investigation should be closed. The two men could now be forced to wait all summer before their case reaches court since they will be closed between 15 July and 15 September.

As a relative, you feel powerless. This can be compared to a similar case where a couple of journalists were detained in an African country, but with the difference that the pressure from Swedish authorities was very high. Here, the guys did not even do anything wrong and yet they are imprisoned without being charged, says Daniel Bakke’s brother, Christian Franzetti to Aftonbladet.

He continues:

I wish that someone would put a foot down, demanding to know what they are being accused of and presented with supporting proofs. I also wish for more backbone and higher pressure. The State Department probably do the best they can, but I wish they took more interest in the case and did more.

The Swedish Foreign Ministry says that they follow the matter closely and have discussions with the Tunisian authorities regarding the Swedes.

We know that the lawyer is trying to push for a main hearing before the summer and we do what we can to bring the matter to the table in our conversations with the Tunisian authorities, says Camilla Åkesson Lindblom at the Foreign Ministry’s press service.

I mer än sju månader har Daniel och Pelle suttit fängslade i Tunisien utan rättegång.

Nu riskerar de att få sitta minst fyra månader till, då landets rättssystem tar semester – och svenskarna börjar tappa hoppet.

– Jag orkar inte ett bakslag nu. Jag är helt slut och måste hem till barnen, skriver Pelle i ett brev från fängelset.

Svenskarna Daniel Bakke, 36, och Per-Åke ”Pelle” Helgesson, 54, åkte i november på uppdrag av företaget ABP World Group till Tunisien för att frita ett barn som förts bort från sin mamma i Norge.

I stället greps de av tunisisk polis, misstänkta för förberedelse för väpnad kidnappning.

Sedan gripandet i november har den norska mamman tilldelats ensam vårdnad av barnet av både norsk och tunisisk domstol, men svenskarna sitter kvar i fängelset Mornaguia, sydväst om huvudstaden Tunis.

Aftonbladet har tidigare berättat om männens rop på hjälp från skräckfängelset där uppges ha trakasserats och misshandlats av personalen.

Vill få uppmärksamhet

Nu väljer männens familjer att träda fram – i hopp om att fallet ska få uppmärksamhet och att männen ska friges.

Melody Guarino Bakke firade i december ettårig bröllopsdag med sin make Daniel – men hon var hemma på Filippinerna där paret bor medan han satt inlåst.

– Orden räcker inte till för att beskriva situationen när man inte vet hur ens make mår. Daniel är det första jag tänker på när jag vaknar och det sista när jag går och lägger mig, säger hon till Aftonbladet.

Hennes önskan är att svenska myndigheter och Utrikesdepartementet ska lägga större resurser på att få svenskarna fria.

I torsdags fick de anhöriga ett dåligt besked då en domare avslog en begäran om att förundersökningen skulle läggas ner. I stället riskerar männen att tvingas vänta hela sommaren innan deras fall når domstol. Mellan 15 juli och 15 september stänger nämligen Tunisiens domstolar.

”Mer ryggrad”

– Som anhörig känner man sig maktlös. Jämför vi med liknande fall där ett par journalister satt i förvar i ett afrikanskt land så var trycket från Sverige mycket högt. Här har killarna inte ens gjort något fel och ändå sitter de utan att åtalas, säger Daniel Bakkes bror Christian Franzetti till Aftonbladet.

Han fortsätter:

– Jag saknar någon som slår näven i bordet, kräver att få veta vad de är misstänkta för och vad det finns för bevis. Mer ryggrad och ett högre tryck. UD gör säkert så gott de kan, men då önskade jag att de kunde mer.

På svenska UD uppger man att man följer ärendet noga och att man för samtal med tunisiska myndigheter om svenskarna.

– Vi vet att advokaten försöker trycka på för att det ska bli en huvudförhandling innan sommaren och vad vi kan göra är att ta upp det i våra samtal med myndigheterna, säger Camilla Åkesson Lindblom på UD:s presstjänst.

Det Utrikesdepartimentet kan göra vid en sådan här situation är att ha kontakt med de frihetsberövade och se till så att de har möjlighet att få en advokat eller tolk. De undersöker också bland annat vad brottsrubriceringen är.

Karin Nylund vid utrikesdepartementets presstjänst säger att det är svårt att veta vad som händer i fallet med Daniel Backe och hans kollega.

– Jag vet inte så mycket. Datum för rättegång är inte fastställt men de har advokat. Advokaten kommer att trycka på för att huvudförhandlingen ska ske före sommaruppehållet och vår ambassadör har fortsatt kontakt med tunisiska myndigheter och advokaten, säger Karin Nylund.

Two abducted Fairfax kids believed to be in Tunisia

Authorities are trying to recover two young Fairfax County children who were allegedly kidnapped by their father and taken to Tunisia.

Three-year-old Zainab Chebbi and 6-year-old Eslam Chebbi have been missing since Nov. 11, when prosecutors say their father, 39-year-old Faical Chebbi, flew with them to Tunisia.

Faical Chebbi called the children’s mother — his ex-wife — the next day and told her that he and the children would not be returning, according to court records. Chebbi was charged in federal court in Alexandria with international parental kidnapping.

Chebbi and Edeanna Johnson-Chebbi divorced in January, nearly a year after she obtained a protective order because he threatened to kill her, according to court documents. Johnson-Chebbi had sole custody of Zainab and Eslam; Chebbi absconded with the children after picking them up from their grandparents’ house in Prince George’s County for a scheduled visit, according to the court documents.

“At first, I was sort of in an action mode,” said Johnson-Chebbi, who created a Facebook page and online petitions about the case.

“What else are you going to do?” she told The Washington Examinerin December. “I won’t allow myself to imagine that this will pass. They will be home. I just don’t know how or when.”

But Johnson-Chebbi faces an uphill battle. There are no treaties or agreements between the United States and Tunisia regarding parental abduction cases.

This summer, Faical Chebbi was added to the FBI Washington Field Office’s Wanted Fugitives list.

Fugitive Wanted For International Parental Kidnapping

The Federal Bureau of Investigation announced today the addition of Faical Ben Abdallah Chebbi, to the “Washington Field Office’s Wanted Fugitives” list. Chebbi, a former resident of Prince George’s County, Md., is a dual citizen of the U.S. and Tunisia and is wanted for international parental kidnapping.

On October 26, 2011, following his divorce proceedings, Chebbi, 40, was awarded visitation rights with his two children, Zainab, 3, and Eslam, 6. On November 11, 2011, Chebbi obtained his children from their maternal grandparents’ residence in Prince George’s County, Md. The children were supposed to be returned on November 13, 2011; however, on November 11, 2011, Chebbi and the children flew from Dulles International Airport in Chantilly, Va., to Germany, and continued to Tunis, Tunisia. On November 12, 2011, Chebbi contacted the children’s mother who resides in Fairfax County, Va., and informed her that he and the children were in Tunisia and would not return to the U.S.

On November 17, 2011, the Circuit Court for Prince George’s County, Maryland, issued an order for Chebbi to return the children. On December 19, 2011, the U.S. District Court for the Eastern District of Virginia issued a federal warrant for Chebbi’s arrest for removing the children from the U.S. and retaining them outside the U.S. with the intent to obstruct the lawful exercise of parental rights.

Chebbi is 6’6” (198 cm) and weighs approximately 200 pounds (91 kg) with black hair, brown eyes and a medium complexion. Chebbi’s daughter, Zainab, has brown hair and brown eyes and has a mole on her right hip. Eslam, Chebbi’s son, has black hair and brown eyes. Both children speak English and are believed to be with Chebbi in Tunisia.

Chebbi speaks fluent Arabic, English and French and is likely to visit Algeria, Libya, Egypt and France. He may use an alias when crossing borders. While residing in the Washington, D.C. area, Chebbi was a limousine driver for several companies and operated his own limousine business called Airport Access. Chebbi is believed to continue to operate a self-employed business in Tunis, Tunisia, under the name Westwind Limousine.

The FBI investigates violations of the International Parental Kidnapping Crime Act (IPKCA) of 1993 which states that a criminal arrest warrant can be issued for a parent who takes a juvenile under 16 outside of the U.S. without the other custodial parent’s permission. The FBI works these cases in partnership with international authorities through the U.S. Department of State, Interpol and FBI Legal Attaché offices.

US Issues Arrest Warrant for Tunisian-American Accused of Abducting His Children

Edeanna Johnson Chebbi, and American citizen, has called for the American and Tunisian governments to help bring back her two children who she says were abducted by her ex-husband, Tunisian-American Faical Chebbi.

According to Ms. Chebbi, her ex-husband picked up the couple’s two children for his bi-weekly visit on Friday, November 11th, 2011, from Ms. Chebbi’s residence in Virginia.  She then received a phone call from her husband the next day: he was calling from Tunisia and had no intentions of returning the children.

Mr. Chebbi granted full legal and physical custody of Eslam, aged 5, and Zainab, aged 2, to his then-wife in January, 2011. In October of the same year, the couple’s divorce was finalized.

Ms. Chebbi holds that Mr. Chebbi violated U.S. law by leaving the country with Eslam and Zainab. At the time that Faical left, both parents were under a court order not to remove the children from the U.S.

There are currently state and federal warrants in the U.S. for the return of Zainab and Eslam, and for the arrest of Faical Chebbi.

Ms. Chebbi has gained attention for her cause in Virginia and within the United States: A petition to return the two children was signed by 18,000 Americans. In addition, a rally was organized in front of the Tunisian Embassy in Washington, D.C.

Ms. Chebbi stated that officials at the Tunisian Embassy reassured her long before the kidnapping that they would not provide Faical with passports for his children without notifying her. However, an official at the embassy told Tunisia Live that they gave Ms. Chebbi no such assurances. The official stated that Mr. Chebbi had every right to acquire Tunisian passports for his two children who, according to Tunisian law, are Tunisian citizens due to their father’s nationality.

The Tunisian Embassy refused to further comment on the case, insisting that they had not broken any Tunisian laws, which are the only laws they are required to follow.

Ms. Chebbi stated to Tunisia Live that she has hired a Tunisian lawyer to plead her case in the country’s courts.

Although in violation of U.S. custody law, Mr. Chebbi is within his legal rights in Tunisia. Tunisian law gives the father full discretion as to where his minor children travel and reside. In addition, children born in a foreign country to a Tunisian father automatically obtain Tunisian citizenship.
