Deputies, DHS worker testify in parental kidnapping case

Mason County Sheriff’s Office deputies Mike Hanson and Derrek Wilson testified Tuesday morning, the second day of the trial of Mark McCallum, who is charged with parental kidnapping.

Hanson testified about talking to McCallum’s now ex-wife Sharon Kludy and the search for their two young children who were later found with their father in Key West, Florida.

Wilson testified about searching the couple’s Hamlin Township home, where Mark had been residing prior to his arrest in Florida.

On Monday, the jury was seated and Kludy testified, answering questions from Mason County Prosecuting Attorney Paul Spaniola.

McCallum is representing himself.

Later in the day a Department of Human Services employee testified about allegations Mark McCallum made that his wife had been abusing the children, saying the department made no determination of abuse.

The jury is done for the day.

Mark McCallum made a motion to dismiss the case, but 51st Circuit Court Judge Richard Cooper denied it.

McCallum’s argument included stating his wife knows one of the deputies and that he turned the rest of law enforcement against him.

“I’m not a crazy person,” McCallum told the court.

More witnesses will be called Wednesday.

Unreported cases of abduction are forecasted to be between 100% and 125% of reported cases. These cases continue to increase due to a flux of immigration migration and both documented (legal) and undocumented (illegal) residents not being aware that they can turn to their government for assistance.

United Kingdom: 

New figures reveal that the number of parental child abduction cases dealt with by the Foreign Office has risen by 88% in under a decade.

In the last year alone the Foreign Office’s Child Abduction Section fielded an average of four calls per day to its specialist advice line, more than half of which were new cases .

The Foreign Office says that that the statistics could be just the tip of the iceberg because many cases go unreported as parents seek custody of their children through foreign courts.

Research commissioned by the Foreign Office shows that half the UK population believes the government can intervene to order the return of a child to the UK if he or she has been abducted by a parent. However, the reality is that whilst help is available, parental child abduction cases can take years to resolve.

Man gets 60 days in child abduction case

A 31-year-old man, arrested this summer at San Francisco International Airport as he allegedly tried to fly to the Middle East with his two young daughters in defiance of a court order, was sentenced Tuesday to two months in Napa County jail.

On July 12, authorities said, Alwawi was detained as he allegedly tried to board a plane with his two daughters to fly to Chicago and then to Amman, Jordan, in defiance of a child abduction prevention order, according to court documents.

His wife, from whom he was separated, had obtained the court order because she had become increasingly concerned that her husband wanted to leave the country with their two girls, according to court filings.

In September, Ahmad Alwawi pleaded no contest in Napa County Superior Court to two counts of child abduction.

A no contest plea, during which defendants neither admit nor dispute a charge, has the same immediate effect as a guilty plea in sentencing hearings.

On Thursday, prosecuting attorney Holly Quate said the 60-day sentence was “fair given the circumstances.”

Alwawi, an unemployed certified public accountant, had found new employment in Saudi Arabia, according to court filings. But he wanted his wife to leave behind her two older children from another relationship, court documents said.

Alwawi was separated from his wife in July, when he allegedly took his girls’ passports  his wife had hidden in an air conditioning vent, according to the probation report.

Alwawi, according to the report, expressed remorse for his actions and stated he has “lost everything.” His plan, Alwawi told the probation officer, was to show the three $8,500 plane tickets to his wife and return them for a refund, according to the court filing.

“The defendant said he then planned on returning home to show his wife that he had the ‘opportunity’ to leave and take their children, but he did not leave because ‘that’s how much I loved’ her. The defendant said he was ‘thinking with his heart and not his head,’” the probation officers wrote.

On Tuesday, Napa County Superior Court Judge Mark Boessenecker also sentenced Alwawi to serve 140 hours of community service and remain under probation for three years. Alwawi also has to obey a family court order, which includes staying away from his wife and two daughters, the judge ruled.

A family court judge on Sept. 30 ordered that Alwawi can only see the two girls three times a week for three hours under supervision.

Alwawi, a former Napa resident who now lives in Benicia, reports to jail on Dec. 1.

Father from US wins custody of child abducted by Japanese mother in Osaka high court

Imagine the plight of an abducted child…abducted by their own parent. For reasons best known to them, couples of failed marriages, and who belong to different nationalities, prefer to kidnap their child to their home country, rather than going through the legal channels for custody. The latest news in this event is the case of a Nicaraguan national living in the US and his estranged Japanese wife, who fled to Japan with their 9-year-old daughter.

The marriage didn’t work out so the 44-year-old mother, thought it better to bring back her daughter to Japan, in spite of the husband being granted custody in a U.S. suit over the couple’s divorce. To make matters worse, the U.S. authorities arrested the Japanese mother in April last year, when she hopped over to Hawaii to renew her green card. She was later released after she surrendered her rights over her daughter.

Apparently the mother sought justice through the Itami branch of the Kobe Family Court in March last year. They ended up granting her custody, but the Osaka High Court has overturned the ruling, stating the girl is accustomed to her life in the US and keeping that it in mind, she must continue to live with the father. The bottom line is, that although Japan has agreed to consider the Hague Treaty, things will not be in favor of the abducted children until Japan avails the facilities of the treaty. Till then, the poor children bear the brunt of their parent’s silly actions.

International child flee cases on increase

Cases of a parent fleeing with their children to a different country are on the increase, a report has said.

 

Head of International Family Justice for England and Wales, Lord Justice Thorpe, said most instances involved eastern European countries.

His office dealt with 180 cases last year compared with 27 in 2007.

The Office of the Head of International Family Justice intervenes in disputes over children, such as custody, when the parents are in different countries.

 

It helps judges and lawyers when cases have stalled because two countries’ legal systems are involved and when international conventions on children’s rights are being flouted by overseas courts.

The International Family Justice annual report said there were 27 cases in 2007, 92 in 2010 and 180 in 2011.

Lord Justice Thorpe said: “The tendency of dangerous parents to bolt when social services are exercising legitimate protective powers is all too common.

“We are seeing a rising number of these types of cases being referred to the office, mostly involving eastern European countries.”

Makeshift shelter

The senior judge said that with almost two-thirds of children born in London in 2010 having a foreign parent there was “the potential for significant future growth” in cases.

Sharon Cooke from the international child abduction charity, Reunite, said the increasing ease of travel was a factor in the rise in case numbers.

“People are relocating, their jobs take them abroad and therefore the chances of meeting different people are greater,” she said.

“There’s a mixed national marriage and they decide to relocate back to England perhaps, or back to another country and unfortunately the relationship may fail and then one party brings the child to another country.”

As an example the report cited the case of two children brought unlawfully from Poland and found living in a makeshift shelter near live railway tracks in England.

They came to the UK with their father and uncle despite social services in Poland having a care order for the children.

In this case a breakdown in communications between English and Polish social services meant it was disputed whether or how the children should be returned to Poland.

Sharp increase in the number of children parentally abducted

Latest figures released by reunite International Child Abduction Centre reveal a 47 per cent increase in the number of child abduction cases reported to their advice line.

The figures show that in 2011 reunite handled 512 new abduction cases. This was made up of 479 children abducted out of the UK, 189 children abducted into the UK, 16 children abducted between UK jurisdictions, and 56 children abducted between non-UK jurisdictions. It has been revealed that the mother was the abducting parent in 70% of the cases reported to reunite.

It is concerning that there has been such a drastic rise in the number of children abducted. The figures do not, however, reveal the true extent of the problem as many cases go unreported. There are a multitude of reasons why child abduction takes place; some parents abduct their children to deny the other parent contact, some out of fear for the child’s safety.

One explanation for the rise in parental abduction could be the rise in multi-cultural relationships. If the child’s parents originate from different countries their first port of call may be to return to their country of origin with the child, especially if they have a support network in that country. This can cause great practical difficulty in locating the child.

The harm caused by child abduction can be great, not only for the parent who is left behind, but for the child who is removed from their usual surroundings. The parent carrying out the abduction often does not consider the emotional effect on the child. The left behind parent has to face both the trauma of their child being abducted and then the legal process involved to try and return their child.

What Qualifies as Parental Kidnapping / Abduction ?

While parental kidnapping laws vary from state to state, two main factors determine whether a parent’s act qualifies as parental kidnapping:

1. The status of child custody
2. A parent’s motives in taking a child away from the other parent

Child custody status

Texas law criminalizes anyone (including a parent) who takes a child knowing that he or she is violating a child custody order. If you are the parent with custody over your child, the child’s other parent cannot do anything that violates the terms of your custody order. Also a parent may not move a child out of the judicial district area if he or she knows that a custody case is currently pending without seeking the permission of the court. Finally, Texas law makes it illegal for non-custodial parents to entice or persuade their children to leave the custodial parent or anyone else acting in that capacity.

For parents who would legitimately like to move, they have to petition the court with jurisdiction over the child custody case. This petition gives the non-custodial parent a chance to oppose the move. While the petition is pending, an act of the non-custodial parent to take the child away to avoid the move would be parental kidnapping.

The motives of a parent taking a child

If no child custody order is in place, the law generally assumes that both parents have equal rights to care for and spend time with their children. Brief trips and vacations with the child – even out of state – can be lawful assuming that the parent taking the child did so in good faith. Parents may not, however, take a child to hide him or her from the other parent or to terrorize the other parent. Many states, including Texas, criminalize this type of intent where one parent maliciously uses the child against the other parent.

Proposed bill targets parental child abduction

HARRISBURG — State Rep. Deberah Kula, D-North Union Township, has introduced legislation aimed at preventing parental child abduction.

This legislation would create guidelines for Pennsylvania courts to follow in custody disputes that involve a parent or guardian deemed at risk of abducting a child.

In 2006, the National Conference of Commissioners on Uniform State Laws met and drafted the Uniform Child Abduction Prevention Act in order to assist states in helping to prevent such abductions.

“It is important that Pennsylvania join other states that have already enacted Uniform Child Abduction Prevention laws,” said Kula. “My legislation would accomplish that, and help to prevent such abductions from happening in the commonwealth.”

Courts would be able to consider risk factors such as a previous attempt or threat to abduct a child, an attempt to obtain a child’s birth certificate, school, or medical records, sudden applications for passports or visas and strong family, financial or cultural ties to a foreign country.

In cases in which a court deems that there is a risk of abduction, a parent would be able to petition the court to order anti-abduction measures, including restricting the travel of the child when the child is with the other parent, restricting access to the child by the other parent and requiring the other parent to surrender any passport or visa held for the child.
